A bill about being forced to pay in order to copyright your art. If you don't pay, anyone will be able to use your work freely without your consent.

They say this bill might be blown out of proportions. It could just be a false alarm.

But I'm not one to believe this until I see some hard evidence.

Oh my god paying to have your work protected ? I can't believe that ! JUST the kind of law I loathe with every fibers of my being...

I was horrified when I saw this!

From what I have read about the subject, the new proposed bill only allows copying if the creator of the work is unable to be contacted by any diligent and reasonable efforts. Meaning they would still have to ask permission, and if the creator says no, the copyright still protects the work.

Don't think that such a bill would work in the EU ... even I don't think seriously such would work anywhere in the world ...

Everyone seems to be talking about it, though I am not surprised.

A perfect example of mass hysteria unfolding before our eyes (or screens, or whatever). Thankfully the intelligent ones are trying to clear up this whole mess.

Anyway, the biggest thing to note, aside from that fact that it's a US law, not an international one... is this.

There is no bill before Congress that enacts any sort of Orphan Works Act.

There was a bill in 2006, called the 'Orphan Works Act of 2006' (H.R. 5439), introduced by Rep. Lamar Smith (R-Texas) on May 22, 2006, with no co-sponsors. H.R. 5439 was introduced in the House Judiciary Committee, which assigned it to the Subcommittee on Courts, the Internet, and Intellectual Property. The subcommittee passed it back up to the full Judiciary Committee with a voice vote.

The full committee did nothing with the bill and it died in committee.

The Orphan Works Act has not been reintroduced during the 2008 congressional session.


I wouldn't get too worried about this.
